Avrupa Konseyi Bakanlar Komitesi Yunanistan’ı Batı Trakya Türk Azınlığına ilişkin Avrupa İnsan Hakları Mahkemesinin kararlarının uygulanması ve Yunan mahkemelerinin yanlış kararlarının düzeltilmesi konusunda bir kez daha uyardı.
Avrupa Konseyi Bakanlar Komitesi, Avrupa İnsan Hakları Mahkemesi’nin (AİHM) İskeçe Türk Birliği, Rodop ili Türk Kadınları Kültür Derneği ve Meriç ili Azınlık Gençleri Derneği’yle ilgili kararları uygulamayan Yunanistan’ı uyardı ve kararların uygulanmasını istedi. Bakanlar Komitesi, Batı Trakya Türk azınlık dernekleriyle ilgili süreci yakından takip etmeye devam edecek.
Avrupa Konseyi Bakanlar Komitesi, 4 – 6 Aralık tarihlerinde Strazburg’da yaptığı toplantıda AİHM kararlarının Yunanistan tarafından uygulanıp uygulanmamasını ele aldı. Avrupa Konseyi Bakanlar Komitesi toplantısı sonrasında yayınlanan açıklamada, Yunanistan’ın Türk azınlık dernekleriyle ilgili uygulamadığı mahkeme kararlarının örgütlenme özgürlüğü ihlallerini ilgilendirdiği hatırlatıldı.
AİHM KARARLARININ UYGULANMAMASI ELEŞTİRİLDİ
Avrupa Konseyi Bakanlar Komitesi, Yunanistan’ın AİHM kararlarının üzerinden on yıl geçmesine rağmen Türk azınlık derneklerin hala resmiyetinin iade edilmemesini ve kurulmak istenen derneklerin kurulmasına izin verilmemesini de eleştirdi. Bakanlar Komitesi açıklamasında geçen yıl Yunan meclisine getirilen ancak daha sonra tepkiler üzerine değiştirilerek kabul edilen yasaya atıfta bulunuldu. Açıklamada; “2017’de yapılan yasa değişikliğine rağmen; Avrupa İnsan Hakları Mahkemesi’nin kararlarının üzerinden on yıl sonra bile mevcut derneklerin ikisi hala kaydedilmemiş ve bir tanesi kapalı kalmaya devam etmektedir” ifadelerine yer verildi.
Açıklamada ayrıca, İskeçe Türk Birliği’nin, 2017 yılında Trakya İstinaf Mahkemesi’ne yaptığı başvurunun prosedür gerekçesiyle reddedildiği ancak kararın temyiz edilerek Yargıtay’a taşındığı da not edildi.
Bakanlar Komitesi, azınlık dernekleri kararlarının Yunanistan’daki mahkemeler tarafından tam ve etkili bir şekilde uygulanması için yetkililerden gerekli tüm tedbirleri almalarını, ayrıca Komiteye de gelişmeler hakkında bilgi vermesini istedi.
Avrupa Konseyi Bakanlar Komitesi, Yunanistan’ı değerlendirdiği toplantıdan sonra yayınladığı açıklamada, Avrupa İnsan Hakları Mahkemesi’nin 2008 kararlarında eleştirdiği gerekçelerle, İskeçe ili Türk Kadınları Kültür Derneği’nin kaydının da 2017 yılında Yargıtay’ın nihai kararı ile reddedildiğine büyük üzüntüyle dikkat çekti.
Avrupa Konseyi Bakanlar Komitesi bu nedenle, Avrupa İnsan Hakları Mahkemesi (AİHM) içtihadının geniş çapta yayılması ve yerel düzeydeki hakimlerin her düzeyde sistematik eğitimi için ek tedbirlerin alınması, yerel mahkemelerin, derneklerin tescili veya feshedilmesi ile ilgili, AİHM içtihadı ile tam ve etkili bir şekilde uyumlu kararlar almasının sağlaması ve Avrupa Konseyi Bakanlar Komitesi’nin gelişmelerden haberdar edilmesini tavsiye etti.

Avrupa Konseyi Bakanlar Komitesi, İskeçe Türk Birliği’nin Yargıtay’a (Arios Pagos) taşıdığı dava kararından sonra veya en geç Eylül 2019’da azınlık dernekleriyle ilgili gelişmeleri yeniden ele alma kararı aldı.
