Belçika’da sığınmacılara uluslararası koruma ve iltica hakkı gibi konularda temyiz mahkemesi görevi üstlenen Yabancı Talepleri Konseyi (CCE), ülkeye Yunanistan’dan gelen sığınmacıların geri gönderilebileceğine hükmetti.
CCE, Yunanistan’dan Belçika’ya giriş yapan Filistinli sığınmacının Dublin Sözleşmesi’nin hükümleri uyarınca Yunanistan’a geri gönderilebileceğini hükmetti. Filistinli sığınmacı hakkında verilen Yunanistan’a geri gönderilme kararını ekim ayında CCE’ye taşımıştı. CCE ise Yunanistan’da koşulların uygun olduğuna hükmederek, sığınmacının geri gönderilebileceği kararını verdi.
Belçika, 2011 yılında Yunanistan’dan giriş yapan sığınmacıları geri göndermeye çalıştığında Avrupa İnsan Hakları Mahkemesi tarafından Avrupa İnsan Hakları Sözleşmesi’ni ihlal ettiği gerekçesiyle kınanmıştı. Mahkeme, Yunanistan’daki sığınmacı merkezlerinin sığınmacılara “insani koşullarda” yaşama imkanı tanımadığını, bu nedenle sığınmacıların geri gönderilmemesi gerektiğini hükmetmişti.
“Sığınmacı tarihinde dönüm noktası”
Belçika’nın aşırı sağcı ve sığınmacı karşıtı tutumuyla tanınan Mülteci ve Göç Bakanı Theo Francken, “Yabancı Talepleri Konseyi’nin (CCE) kararı sığınmacı tarihinde bir dönüm noktası teşkil ediyor.” açıklamasında bulundu.
Filistinli sığınmacının gelecek hafta Yunanistan’a geri gönderileceğini duyuran Francken, yakın dönemde büyük bir grup sığınmacının Yunanistan’a geri gönderileceğini söyledi.
Francken, Yunanistan’daki sığınmacı merkezlerinde iyileşme olduğunu vurgulayarak, “Yunanistan yıllardır yüklü miktarda AB parası alıyor. Milyonlarca avrodan bahsediyoruz. Yunanistan’ın gerekli adımları atmaya başlaması memnuniyet verici.” ifadesini kullandı.
Dublin Sözleşmesi uyarınca, sığınmacının iltica başvurusunu Avrupa Birliği’ne (AB) giriş yaptığı ülkede yapması gerekiyor. Eğer sığınmacı, başka bir AB ülkesine giderse, o ülke, sığınmacının haklarını ihlal etmeden kişiyi AB’ye ilk giriş yaptığı ülkeye gönderme hakkına sahip bulunuyor.
